Terms of Service
CareYeti LLC ("CareYeti", "we", "us") Effective date: October 17, 2026
These terms govern use of the CareYeti web app, mobile app, phone line and related services (the "Service"). By using the Service you agree to them. If you use it for an Agency, you confirm you are authorized to do so. Your Agency's written agreement with CareYeti (if any) controls where it conflicts with these terms.
1. Who may use the Service
The Service is for home and community care Agencies and the staff and caregivers they authorize. Accounts are created by your Agency; you cannot register on your own. You must give accurate information and keep your credentials confidential. You are responsible for activity under your account. Tell your Agency and us right away if you suspect it was used without permission.
2. Agencies and data
The Agency owns its data and decides who has access and what is entered. CareYeti processes that data on the Agency's behalf to provide the Service, as described in the Privacy Policy. Where the Agency is a HIPAA covered entity, the parties handle PHI under a Business Associate Agreement; the BAA governs PHI if it conflicts with these terms. The Agency is responsible for having a lawful basis and any needed consents to enter client and caregiver data, and for its own HIPAA and licensing obligations.
3. Accurate EVV records
EVV records support billing, payroll and state and federal compliance. You agree to:
- clock in and out only for real visits, at the client's service location, for the time actually worked;
- not falsify, alter or fabricate visit times, locations or notes, share your PIN or login, or clock in for someone else;
- not use tools to fake GPS location or the device clock.
You understand that the Service records your device's GPS location at clock-in and clock-out and the device time alongside our server's receipt time, and that visits with suspicious times may be held for administrator review. Falsified records may violate law and can lead to loss of access and be reported to the Agency, payers or authorities.
4. Acceptable use
Do not: access data you are not authorized to see; try to bypass security, tenant separation or rate limits; probe, scrape or load-test the Service without permission; upload malware or unlawful content; reverse engineer the Service except where law allows; or use it to send spam. We may suspend access to protect the Service, the data or other users.
5. Phone
Phone clock-in uses a telephony provider and logs calls. Standard carrier rates may apply to your calls. You are responsible for entering your PIN privately.
6. Your content
You and your Agency keep ownership of data you submit. You give CareYeti a limited license to host, process, transmit and display it only to run and support the Service for the Agency, to keep required records, and as the law requires.
7. Retention and deletion
Visit, EVV, payroll and audit records are retained for at least 7 years (longer if the Agency sets a longer period), and are not removed when an individual deletes their login. A user may delete their own login in the app. That removes the login and personal profile data, while retained records stay in de-identified form as described in the Privacy Policy. When an Agency ends its relationship with us, its data is held for the retention period and then deleted.
8. Fees
Fees, billing and term for Agencies are set in the Agency's order form or agreement. Individual caregivers are not charged by CareYeti.
9. Our property
CareYeti and its licensors own the Service, software, name and branding. These terms give you only a limited, revocable, non-transferable right to use the Service as intended.
10. Availability and no clinical or legal advice
We work to keep the Service available but do not promise uninterrupted or error-free operation. The Service is not an emergency system: in an emergency call 911. It does not provide medical, clinical, legal or billing advice, and the Agency remains responsible for the care it delivers, its schedules, and the accuracy of what it submits to payers.
11. Disclaimers
The Service is provided "as is" and "as available." To the extent the law allows, CareYeti disclaims all implied warranties, including merchantability, fitness for a particular purpose and non-infringement.
12. Limitation of liability
To the extent the law allows, CareYeti is not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data, arising from use of the Service. Our total liability for any claim is limited to the fees the Agency paid us for the Service in the 12 months before the claim (or, for a user with no fees, US$100). Nothing in these terms limits liability that cannot be limited by law, or obligations under a BAA.
13. Suspension and termination
You may stop using the Service at any time. We or your Agency may suspend or end your access for breach of these terms or to protect the Service. Sections that by their nature should continue (records retention, ownership, disclaimers, liability, governing law) survive termination.
14. Changes
We may update these terms. We will post the new version and effective date, and notify Agencies of material changes. Continued use after the effective date means you accept the update.
15. Governing law and disputes
These terms are governed by the laws of the State of Minnesota, without regard to conflict-of-laws rules. The state and federal courts located in Ramsey County, Minnesota have exclusive jurisdiction, except that either party may seek injunctive relief anywhere to protect its rights.
